GENERAL TERMS AND CONDITIONS

This website contains information about products and services offered by LERGISS MK, Craft Company for Clothing Production and Trade, owner Zrinka Ljaljić, Matija Ivanića 2E, 32100 Vinkovci, Croatia and serves as an electronic selling point for the company web shop.

The terms and conditions for online trade (www.lergiss.com) have been compiled in accordance with the current Consumer Protection Act (ZZP) and the Law on Compulsory relations (ZOO).

Please read all the terms and conditions listed below carefully. By ordering a product, the buyer confirms acceptance of these terms of purchase.

CUSTOMER

The buyer is any legal and physical person who makes an order and payment in an online store (www.lergiss.com).

PRE-CONTRACTUAL NOTICES

In accordance with Article 57 of the Consumer Protection Law, the seller must inform the buyer in a clear and understandable manner about:

1. The main characteristics of the goods or services to the extent appropriate with respect to the goods or service and the medium used to transmit the notification.
2. Name and headquarters, telephone number if applicable and e-mail address.
3. If applicable, the name and headquarters of the trader on whose behalf and/or for whose account.
4. Geographical address of the place of business, i.e. geographical address of the trader’s place of business on whose behalf and/or for whose account he performs, and to which the consumer may address his complaints, if that place is different from the seat referred to in point 2 of this article.
5. The retail price of the goods or services, and if the nature of the goods or services does not allow the price to be calculated in advance, the method of calculating the price and, where applicable, other costs of transport, delivery or postal services, or that such costs may be charged, if they cannot be reasonably calculated in advance.
6. The costs of using the means of remote communication for the purpose of concluding the contract, if these costs are not charged at the base tariff.
7. Conditions of payment, the conditions of delivery of the goods or the provision of the service, the time of delivery of the goods or the provision of the service, and, where available, the method of resolving a consumer complaint.
8. Conditions, deadlines and procedure for the exercise of the right to unilateral termination of the contract as well as the form for unilateral termination of the contract in accordance with Article 74 Paragraph 1 of this Law, in cases where that right exists.
9. That the consumer is obligated to bear the costs of returning the goods in the event that he/she uses his/her right to unilateral termination of the contract referred to in Article 72 of this Law, i.e. on the costs of returning the goods, in the event that, in the case of a distance contract, the goods cannot be returned by mail in the usual manner.
10. That, in the event that he/she uses his/her right to unilateral termination of the contract referred to in Article 72 of this law after having made a request in accordance with Article 64 or Article 70 of this law, the consumer shall be obliged to pay the trader a reasonable portion of the price in accordance with Article 77 Paragraph 7 of this Law.
11. That the consumer cannot use the right to unilateral termination of the contract referred to in Article 72 of this law in cases where it is under Article 79 of this law, the right to exclude, or the assumptions under which the consumer loses the right to unilateral termination of the contract.
12. The existence of responsibility for material deficiencies.
13. Services or assistance offered to the consumer after the sale and the terms of use of those services or assistance, provided that the trader provides them, as well as any guarantees issued with the goods or service.
14. Appropriate rules of conduct for the trader, as defined in Article 5 of Regulation (EU) Paragraph 18 of this law.
15. Duration of the contract, if the contract is concluded for a certain period of time, i.e. the conditions of cancellation or termination of the contract which has been concluded indefinitely, or which is automatically extended.
16. Where the consumer is bound by the contract, if applicable.
17. Deposit or other financial insurance that the consumer is obligated to pay or obtain on the request of the trader, as well as on the terms of payment of that deposit, or the conditions for obtaining other financial insurance.
18. Where applicable, the functionality of the digital content, including the necessary technical safeguards for such content.
19. Where applicable, the interoperability of digital content with computer or software equipment for which the trader knows or should know.
20. Out-of-court dispute resolution mechanisms, i.e. reparation systems, and how the consumer can use them.

RECEIPT/CERTIFICATE OF CONTRACT CONCLUDED

The receipt that the customer receives together with the ordered goods or in email is the certificate of the contract entered and contains all the necessary information referred to in Article 57 ZZP.

RULES OF PROCEDURE OF TRADERS

These terms of purchase constitute the rules of conduct whereby the Trader undertakes to act in his/her commercial practice.

PRICES

Prices are in official Croatian currency – EUR and VAT is included in the price. Prices, payment terms and special offers are valid only at the time of the order and can be changed without notice.

ORDERS

Ordering goods through an online store can be arranged 24 hours a day, 7 days a week. You can order as a registered or unregistered user.
All products listed at the online store (www.lergiss.com) are located in stock or will be made to order are available for order in limited quantities. If a particular product is not available at the time of ordering, the customer will be notified and will be offered the most similar substitute product or refund.
The buyer is responsible for the accuracy and completeness of the data entered during registration and order.

ACTION SALE AND DISCOUNT CODES

LERGISS MK will periodically, by its own decision, put certain products on special offer. These products will be available under the same conditions to all customers or will be available to customers of a specific, targeted group.

After the sale expires, LERGISS MK will not receive new orders under the terms and conditions relating to the expired special offer. The merchant reserves the right to sell until the stock runs out.

The merchant reserves the right to temporarily suspend the validity of promo codes during sales promotions, or the validity period of other discount codes. Discounts or benefits automatically granted in the shopping cart cannot be combined with discount codes.

SECURITY OF ONLINE PAYMENTS

While conducting payments on our web shop you are using CorvusPay – an advanced system for secure acceptance of credit cards on the Internet.

CorvusPay system ensures complete privacy of your credit card data and personal data from the moment you type them into the CorvusPay payment form. Data required for billing is forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. PRIVACY STATEMENT

In accordance with the provisions of the Consumer Protection Act (“Official Gazette” number 41/14), Article 11, LERGISS MK does not provide customer personal data to a third party without prior express and written permission of the customer and only collects basic information about customers/users.

We undertake to apply maximum safety measures to protect the interests of customers and to prevent any misuse of information. In the process of realisation of the purchase, we will only use the information that is necessary.

Regular customers are given the option to choose to use their data, including the ability to decide whether or not to remove their name from the lists used for marketing campaigns.

All customer data is strictly safeguarded and is available exclusively to employees who have specified that the information is necessary for the business and will not be sold, disclosed, or given to a third party. All employees are responsible for respecting the principles of privacy protection.

APPLICATION OF COOKIES

LERGISS MK website (www.lergiss.com) uses Cookies – text files placed on the user/visitor’s computer by the Web server used by the visitor. Files arise when the browser on the user’s device is loaded by the website that he/she visited, which then sends the data to the browser that then creates a text file (Cookie). The browser retrieves and sends the file to the server Web pages (sites, pages) when users return to it and thus provides users with more online capabilities and a better user experience.

It is important to emphasise that the LERGISS MK website (www.lergiss.com) cannot access other files on the user’s computer or gain access to information that the user has not previously given. It does not contain Cookies that allow you to run programmes or install viruses on your computer.

The information collected includes the user’s IP address, browser information, language, operating system and other standard statistical data collected and analysed solely in an anonymous and mass form. The www.lergiss.com website uses Google Analytics statistics. Information about how users use the LERGISS MK website can occasionally be collected using other tools similar to Google Analytics.

TERMS OF DELIVERY

The package is delivered to the address via the delivery service Paket24 – Hrvatska Pošta for national and international shipping.

Delivery is made on the territory of Croatia and all EU member countries: Austria, Belgium, Bulgaria, Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Germany, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden).

CROATIA

Fast delivery (as a rule from 2 to 7 working days), if the products are available immediately, is only valid for the Republic of Croatia.

The shipping for Croatia is free!

EU MEMBER COUNTRIES

Delivery to countries outside Croatia can take up to 20 working days, and as a rule up to 5 to 10 working days.

The shipping for EU member countries is free!

The speed of delivery may deviate from the usual during holidays, non-working days, during large sales campaigns and other situations in which there are possible difficulties during delivery.

GENERAL TERMS OF PACKAGE DELIVERY AND COLLECTION

We ship all orders within 2 to 7 working days after the order has been correctly placed and paid for, or within the time period specified as the production time on the purchased products.

The time of sending and delivery/delivery of the package is shifted to the first following working day in the case of holidays and public holidays.

If you want delivery on a specific date, please let us know in the notes with the order.

The products will be packed so that they cannot be damaged by normal handling during transport. When picking up the shipment, the buyer is obliged to check any EXTERNAL damage to the shipment, i.e. the package, and immediately report them to the delivery person, or refuse to pick up a shipment with visible major external damage.

In this case, please contact us so that we can check the status of the shipment as soon as possible and agree on further procedures for the related order, i.e. the shipment.

REFUND CONDITIONS, RECLAMATION AND REPLACEMENT

SIMPLE REFUNDS

If you are not satisfied with the product you have ordered, you can return it for a full refund, including the amount of the delivery if conditions are met.

All returned products must be unused and in the original packaging.

The cost of shipping to our warehouse for the products you are returning is borne by yourself (by post or delivery service), except in cases of refunds or replacement of defective products, when all costs are borne by LERGISS MK. 

According to Article 79 of the Consumer Protection Act, the buyer has no right to terminate the contract (order): if the products were made to order.

For refunds of unused and non-opened products in our warehouse please contact us by e-mail info@lergiss.com.

NOTES

• Refunds and replacements must be pre-negotiated.
• If you wish a refund in addition to the goods which satisfy the refund, a copy of the invoice must be provided and the account number (IBAN) to which we reimburse the funds or if paid by card, refund will be completed directly to card.
• Reimbursement will be made in accordance with the legal deadline of 14 days (ZZP), i.e. after we receive the product at the warehouse.
• When returning the product, the buyer is liable to properly package the product(s) in the cardboard box in order to avoid damage to the product during transport. If damage occurs because the buyer did not protect the product when packing (e.g., returned products wrapped in plain paper or in a bag), the refund or replacement will not be accepted.
• You must make the return of the goods without delay and at the latest within 14 days from the day you have given us a unilateral termination of the contract.

DELIVERY DEFECTS, WRONG PRODUCTS, DEFECTIVE PRODUCTS

The buyer has the right to exchange goods or return goods in exchange for money at our expense if one of the following scenarios occurs: delivery of goods not ordered, delivery of goods that do not match the description on the official website LERGISS MK and if the delivered goods have visible errors and damage.

In case of damage during delivery, wrongly delivered goods or a defective product, please contact us by e-mail: info@lergiss.com within two working days of receipt of the consignment. 

All complaints will be resolved in the quickest possible time. In these cases, LERGISS MK covers all costs of replacing the product.

RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT (EXTRACT FROM ZZP, ARTICLE 72)

1. The consumer shall have the right, without giving reasons, to unilaterally terminate the contract concluded outside the premises or concluded at a distance within 14 days.
2. In the case of the conclusion of a purchase agreement, the deadline referred to in Paragraph 1, this article shall begin to run from the date on which the consumer or a third party designated by the consumer, other than the carrier, and the goods subject to the contract are committed to possession.
3. Where an order has been commissioned by a consumer for several pieces of goods to be delivered separately, i.e. where goods are delivered in several pieces or more, the period referred to in Paragraph 1, this article shall begin to run from the date on which the consumer or a third party designated by the customer, other than the carrier, is given possession of the last piece or last consignment of goods.
4. If the regular supply of goods is contracted for a specified period, the period referred to in Paragraph 1, this article shall begin to run from the date on which the consumer or a third party designated by the customer, other than the carrier, is given possession of the first piece or first consignment of goods.
5. In the case of the conclusion of a service contract, a contract for the supply of water, gas or electricity sold in an unlimited volume or unlimited quantity and the supply of heat energy, as well as in the case of the conclusion of a contract which is subject to a digital content that has not been delivered to the body medium, the deadline referred to in paragraph 1, this article shall begin to run from the date of conclusion of the contract.

FORM FOR UNILATERAL TERMINATION OF CONTRACT

You can complete and send a copy of the form for unilateral termination of the contract on our website. We will submit to you, without delay, the receipt of the notification of unilateral termination of the contract by e-mail. The form for unilateral termination of the contract can be downloaded HERE.

Instructions for unilateral termination of the contract:

• You can terminate the contract unilaterally within 14 days without specifying a reason.
• In order to be entitled to unilateral termination of this agreement, you must inform us of your decision to unilaterally terminate the contract before the expiry of the deadline with an unambiguous statement sent by mail or e-mail, specifying your name and surname, address, telephone number and email address. You can use the enclosed example form for the unilateral termination of the contract.
• The deadline for unilateral termination is 14 days from the day on which you or a third party designated by you, other than the carrier and the goods which are the subject of the contract to the property.
• If you unilaterally terminate this agreement, we will refund the money we have received from you, including delivery costs, without delay and at the latest within 14 days from the day we receive your decision on unilateral termination of the contract, unless you have chosen another type of delivery, which is not the cheapest standard delivery offered by us.
• Refunds will be made in the same way that you made your payment. In the event that you agree to a different refund of the amount paid, you do not incur any costs in relation to the refund.
• Refunds can only be made after the goods are returned to us, or after you provide us with proof that you have sent the goods back to us.
• You are deemed to have performed your duty on time if you have sent the goods to our address before the expiry of the deadline.
• You must bear the direct costs of returning the goods yourself.
• You are responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods.

Obligations of the consumer in the event of the unilateral termination of the contract (statement from ZZP, article 77.)

1. Unless the trader has offered to take over the goods that the consumer has taken himself, the consumer must recover the goods without delay and at the latest within 14 days from when, in accordance with Article 74 of this law, informed the trader of his decision to terminate the contract.
2. The consumer shall be deemed to have exercised his obligation under paragraph 1 of this article on time if, before the expiry of the deadline referred to in paragraph 1. This article shall send the goods or hand them over to the trader or to the person authorised by the trader to receive the goods.
3. (3) The consumer must bear only the direct costs of returning the goods unless the trader has agreed to bear those costs or if the trader has failed to inform the consumer that he is obligated to bear those costs.
4. If, in the case of a contract concluded outside the premises, the goods were delivered to the consumer at his home at the time of the conclusion of the contract, the trader must recuperate the goods at his/her own expense if, due to its nature, the goods cannot be returned in the usual manner by post.
5. The consumer shall be liable for any impairment of the value of the goods resulting from the handling of goods, other than that which was necessary to determine the nature, characteristics and functionality of the goods.
6. Exceptionally, from paragraph 5 of this article, if the trader has not informed the consumer of his right to unilateral termination of the contract in accordance with Article 57 in point 8 of this law, the consumer is not liable for the impairment of the goods, irrespective of the cause of impairment of the goods.
7. If the customer unilaterally terminates the contract after it is in accordance with Articles 64 and 70, it is expressly required that the provision of the service or the fulfilment of a contract for the supply of water, gas, electricity sold in an unlimited volume or unlimited quantity and the supply of heat energy is initiated before the expiry of the deadline for one-sided termination, the consumer shall pay the trader part of the contract price which is proportionate to what the trader has fulfilled to the consumer by the time the consumer has informed him that he is using his right to unilaterally terminate the contract, with the proportionate amount. The price payable by the consumer shall be calculated on the basis of the total contracted price, and if that price is inordinate, on the basis of the market value of what the trader has fulfilled to the consumer.
8. If a unilateral termination of a service contract or a contract for the supply of water, gas or electricity sold in an unlimited volume or unlimited quantity and the supply of heat energy, the consumer shall not be obliged to pay part of the price commensurate to that. That the trader has fulfilled the consumer for the duration of the deadline for the unilateral termination of the contract, if the trader has not provided the consumer with the notices foreseen by the provisions of Article 57 of paragraph 1, Points 8 and 10 of this law, or if the consumer is not in accordance with Articles 64 or 70, it is expressly demanded that the provision of the service commence before the expiry of the deadline for unilateral termination of the contract.
9. If the customer unilaterally terminates a contract that has digital content that has not been supplied in a physical medium, the consumer will not be obliged to pay a portion of the price or costs commensurate to what the trader has fulfilled to the consumer for the duration of the one-sided termination of the contract, if it has not given its explicit consent to the fulfilment of the contract before the expiry of the 14-day period referred to in Article 72 of this law, if it has not confirmed that it is familiar with the fact that by giving such consent, loses the right to unilateral termination of the contract or if the trader has failed to notify it in accordance with Articles 63 or 69 of this law.

Exclusion of the right to unilateral termination of the contract (statement from ZZP, article 79.)

The consumer is not entitled to unilateral termination of the contract from this section if:

• The service contract was fulfilled by the trader, and the fulfilment began with the explicit prior consent of the consumer and with his confirmation that he was aware of the fact that he would lose the right to unilateral termination of the contract from this section if the service was fulfilled.
• The subject of the contract to the consumer specification or which is clearly adapted to the consumer.
• The subject of the contract is easily per cording goods or goods that are approaching the expiry date.
• The contract subject sealed goods which, for health or hygiene reasons, are not suitable for return, if unsealed after delivery

The consumer is obligated to bear the costs of returning the goods to the LERGISS MK warehouse in the event that he/she uses his/her right to the unilateral termination of the contract referred to in Article 72. ZZP.

RESPONSIBILITY FOR MATERIAL DEFECTS

LERGISS MK is responsible for material defects of the items it sells on its website according to the positive regulations of the Republic of Croatia, especially the law on compulsory relations.

EXTRAJUDICIAL RESOLUTION OF CONSUMER DISPUTES

In the event of a dispute between a consumer and a trader, an application may be submitted to the Court of Honour of the Croatian Chamber of Trades and Crafts or a proposal for mediation at conciliation centres.

STATEMENT OF DELIVERY AND SUBMISSION OF PACKAGES

Over 95% of the packages sent by LERGISS MK are delivered on schedule by the delivery service Paket24 i Hrvatska Pošta (Croatian Post). The employees of LERGISS MK make every effort to ensure that delivery and the distribution of packages are carried out in accordance with the schedule. LERGISS MK (www.lergiss.com) cannot be held liable at any time for delays in deliveries caused by a delivery service or by “force majeure”.

SUBMISSION OF CONSUMER COMPLAINTS

According to Article 10 of the Consumer Protection Law, we inform consumers that any objection to the quality of our services can be delivered in writing (by post) to this address: LERGISS MK, obrt za proizvodnju odjeće i trgovinu, vl. LERGISS MK will reply to your objection in writing no later than 15 days from the date of receipt of the complaint. Please provide the following information in the complaint: first and last name, and the address to which LERGISS MK should reply.

Ove internetske stranice sadrže informacije o proizvodima i uslugama koje nudi LERGISS MK, obrt za proizvodnju odjeće i trgovinu, vl. Zrinka Ljaljić, Matija Ivanića 2E, 32100 Vinkovci te služe kao elektroničko prodajno mjesto obrta – internetska trgovina.

Uvjeti poslovanja internetske trgovine (www.lergiss.com) sastavljeni su u skladu sa aktualnim Zakonom o zaštiti potrošača (ZZP) i Zakonom o obveznim odnosima (ZOO).

Molimo vas da pažljivo pročitate sve niže navedene uvjete kupnje i poslovanja. Narudžbom proizvoda Kupac potvrđuje prihvaćanje ovih uvjeta kupnje.

KUPAC

Kupac je svaka pravna i fizička osoba koja izvrši narudžbu i plaćanje u internetskoj trgovini (www.lergiss.com).

PREDUGOVORNE OBAVIJESTI

Sukladno članku 57. Zakona o zaštiti potrošača, Prodavatelj mora Kupca na jasan i razumljiv način obavijestiti o:

1. Glavnim obilježjima robe ili usluge, u mjeri u kojoj je to prikladno s obzirom na robu ili uslugu te medij koji se koristi za prijenos obavijesti.
2. Svojem nazivu i sjedištu, telefonskom broju te, ako postoji, adresi elektroničke pošte.
3. Ako je primjenjivo, nazivu i sjedištu trgovca u čije ime i/ili za čiji račun nastupa.
4. Zemljopisnoj adresi mjesta svojeg poslovanja, odnosno zemljopisnoj adresi mjesta poslovanja trgovca u čije ime i/ili za čiji račun on nastupa, a na koju potrošač može nasloviti svoje pritužbe, ako je to mjesto različito od sjedišta iz točke 2. ovoga članka.
5. Maloprodajnoj cijeni robe ili usluge, a ako priroda robe ili usluge ne omogućava da cijena bude izračunata unaprijed, o načinu izračuna cijene te, ako je primjenjivo, ostalim troškovima prijevoza, dostave ili poštanskih usluga, odnosno o tome da ti troškovi mogu biti naplaćeni, ako ne mogu biti razumno izračunati unaprijed.
6. Troškovima uporabe sredstava daljinske komunikacije u svrhu sklapanja ugovora, ako se ti troškovi ne zaračunavaju po osnovnoj tarifi.
7. Uvjetima plaćanja, uvjetima isporuke robe ili pružanja usluge, vremenu isporuke robe ili pružanja usluge te, ako postoji, načinu rješavanja potrošačkih pritužbi od strane trgovca.
8. Uvjetima, rokovima i postupku izvršavanja prava na jednostrani raskid ugovora kao i o obrascu za jednostrani raskid ugovora sukladno članku 74. stavku 1. ovoga Zakona, u slučajevima u kojima to pravo postoji.
9. Tome da je potrošač dužan snositi troškove vraćanja robe u slučaju da iskoristi svoje pravo na jednostrani raskid ugovora iz članka 72. ovoga Zakona, odnosno, o troškovima vraćanja robe, u slučaju da kod ugovora sklopljenih na daljinu roba zbog svoje prirode ne može biti vraćena poštom na uobičajen način.
10. Tome da će, u slučaju da iskoristi svoje pravo na jednostrani raskid ugovora iz članka 72. ovoga Zakona nakon što je postavio zahtjev u skladu s člankom 64. ili člankom 70. ovoga Zakona, potrošač biti dužan platiti trgovcu razumni dio cijene sukladno članku 77. stavku 7. ovoga Zakona.
11. Tome da se potrošač ne može koristiti pravom na jednostrani raskid ugovora iz članka 72. ovoga Zakona, u slučajevima u kojima je temeljem članka 79. ovoga Zakona, to pravo isključeno, odnosno o pretpostavkama pod kojima potrošač gubi pravo na jednostrani raskid ugovora.
12. Postojanju odgovornosti za materijalne nedostatke.
13. Uslugama ili pomoći koji se potrošaču nude nakon prodaje te uvjetima korištenja tih usluga ili pomoći, ako ih trgovac pruža, kao i o eventualnim jamstvima koja su izdana uz robu ili uslugu.
14. Postojanju odgovarajućih pravila postupanja trgovca, kako su definirani člankom 5. točkom 18. ovoga Zakona.
15. Trajanju ugovora, ako je ugovor sklopljen na određeno vrijeme, odnosno uvjetima otkaza ili raskida ugovora koji je sklopljen na neodređeno vrijeme, odnosno koji se automatski produžuje.
16. Minimalnom roku u kojem je potrošač vezan ugovorom, ako postoji.
17. Pologu ili drugom financijskom osiguranju koje je potrošač na zahtjev trgovca dužan platiti ili pribaviti, kao i o uvjetima plaćanja toga pologa, odnosno uvjetima pribavljanja drugog financijskog osiguranja.
18. Ako je primjenjivo, funkcionalnosti digitalnog sadržaja, uključujući potrebnim mjerama tehničke zaštite tih sadržaja.
19. Ako je primjenjivo, interoperabilnosti digitalnog sadržaja s računalnom ili programskom opremom za koju trgovac zna ili bi morao znati.
20. Mehanizmima izvansudskog rješavanja sporova, odnosno o sustavima za obeštećenje, te načinu kako ih potrošač može koristiti.

Sve naprijed navedene obavijesti, tj. one koje su sukladno Zakonu o zaštiti potrošača neophodne, nalaze se u ovim Uvjetima Poslovanja na lergiss.com internetskoj stranici (www.lergiss.com).

RAČUN / POTVRDA O SKLOPLJENOM UGOVORU

Račun koji će kupac primiti zajedno s naručenom robom ili e-mailom predstavlja potvrdu o sklopljenom ugovoru te sadrži sve potrebne podatke iz članka 57. ZZP. 

PRAVILA POSTUPANJA TRGOVACA 

Ovi uvjeti kupnje predstavljaju pravila postupanja po kojima se trgovac obvezuje postupati u svojoj poslovnoj praksi.

CIJENE

Cijene su izražene u službenoj valuti u Hrvatskoj, eurima – EUR, a PDV je uračunat u cijenu. Cijene, uvjeti plaćanja i akcijske ponude vrijede isključivo u trenutku narudžbe i mogu se promijeniti bez prethodne najave.

NARUDŽBE

Naručivanje robe putem internetske trgovine moguće je 24 sata na dan, 7 dana u tjednu. Naručiti možete kao registrirani i kao neregistrirani korisnik.
Svi proizvodi navedeni na internetskoj trgovini (www.lergiss.com) nalaze se na skladištu ili će biti napravljeni, te su raspoloživi za narudžbu u ograničenim količinama. Ako određeni proizvod u trenutku narudžbe nije raspoloživ, kupac će biti obaviješten te će mu biti ponuđen najsličniji zamjenski proizvod ili povrat novaca.
Kupac snosi odgovornost za točnost i potpunost unesenih podataka prilikom registracije i narudžbe.

AKCIJSKA PRODAJA I KODOVI ZA POPUST

Obrt LERGISS MK će periodično, po svojoj odluci stavljati određene proizvode na akcijsku prodaju. Ti proizvodi će biti dostupni pod istim uvjetima svim kupcima ili će biti dostupni kupcima određene, točno specificirane skupine.

Nakon isteka roka akcijske prodaje, obrt LERGISS MK neće primati nove narudžbe po uvjetima koji se odnose na akcijsku prodaju kojoj je istekao rok. Trgovac zadržava pravo prodaje do isteka zaliha.

Trgovac zadržava pravo privremenog obustavljanja valjanosti promo kodova tijekom prodajnih akcija, odnosno razdoblja valjanosti drugih kodova za popust. Popuste ili pogodnosti koji se automatski dodjeljuju u košarici nije moguće kombinirati s kodovima za popust. 

IZJAVA O SIGURNOSTI PLAĆANJA

Pri plaćanju karticama na LERGISS MK internetskoj trgovini koristite CorvusPay – napredni sustav za siguran prihvat platnih kartica putem interneta.

CorvusPay sustav osigurava potpunu tajnost Vaših kartičnih i osobnih podataka već od trenutka kada ih upišete u CorvusPay platni formular. Platni podaci prosljeđuju se šifrirano od Vašeg web preglednika do banke koja je izdala Vašu karticu. Naša trgovina nikada ne dolazi u kontakt s cjelovitim podacima o Vašoj platnoj kartici. Također, podaci su nedostupni čak i djelatnicima CorvusPay sustava. Izolirana jezgra samostalno prenosi i upravlja osjetljivim podacima, čuvajući ih pri tom potpuno sigurnima.

Formular za upis platnih podataka osiguran je SSL transportnom šifrom najveće pouzdanosti. Svi skladišteni podaci dodatno su zaštićeni šifriranjem, korištenjem kriptografskog uređaja certificiranog prema FIPS 140-2 Level 3 standardu. CorvusPay zadovoljava sve zahtjeve vezane uz sigurnost on-line plaćanja propisane od strane vodećih kartičnih brandova, odnosno posluje sukladno normi – PCI DSS Level 1 – najviši sigurnosni standard industrije platnih kartica. Pri plaćanju karticama uvrštenim u 3-D Secure program Vaša banka uz valjanost same kartice dodatno potvrđuje i Vaš identitet pomoću tokena ili lozinke.

Corvus Pay sve prikupljene informacije smatra tajnom i tretira ih u skladu s tim. Informacije se koriste isključivo u svrhe za koje su namijenjene. Vaši osjetljivi podaci u potpunosti su sigurni, a njihova privatnost zajamčena je najmodernijim zaštitnim mehanizmima. Prikupljaju se samo podaci nužni za obavljanje posla sukladno propisanim zahtjevnim procedurama za on-line plaćanje.

Sigurnosne kontrole i operativne procedure primijenjene na našu infrastrukturu osiguravaju trenutnu pouzdanost CorvusPay sustava. Uz to održavanjem stroge kontrole pristupa, redovitim praćenjem sigurnosti i dubinskim provjerama za sprječavanje ranjivosti mreže te planskim provođenjem odredbi o informacijskoj sigurnosti trajno održavaju i unaprjeđuju stupanj sigurnosti sustava zaštitom Vaših kartičnih podataka.

IZJAVA O PRIVATNOSTI

Sukladno odredbama Zakona o zaštiti potrošača (“Narodne novine” broj 41/14), članak 11., Obrt LERGISS MK ne ustupa osobne podatke kupaca trećoj osobi bez prethodnog izričitog i pisanog odobrenja kupca te prikuplja isključivo osnovne podatke o kupcima/korisnicima.

Obvezujemo se primjenjivati maksimalne mjere sigurnosti u svrhu zaštite interesa kupaca i sprječavanja eventualnih zlouporaba informacija. U procesu realizacije kupovine koristit ćemo samo informacije koje su nužne.

Redovito se kupcima daje mogućnost izbora o upotrebi njihovih podataka, uključujući mogućnost odluke žele li ili ne da se njihovo ime ukloni s lista koje se koriste za marketinške kampanje.

Svi se podaci o kupcima strogo čuvaju i dostupni su isključivo djelatnicima kojima su navedeni podaci nužni u poslovanju te neće biti prodani, iznijeti ili dati trećoj strani. Svi djelatnici odgovorni su za poštivanje načela zaštite privatnosti.

PRIMJENA KOLAČIĆA

Na LERGISS MK internetskoj trgovini (www.lergiss.com) koriste se tzv. kolačići (cookies) – tekstualne datoteke koje na računalo korisnika/posjetitelja smješta web poslužitelj kojim se posjetitelj koristi. Datoteke nastaju kada preglednik na uređaju korisnika učita internetske stranice koje je posjetio, koje potom šalju podatke pregledniku koji zatim izrađuje tekstualnu datoteku (kolačić). Preglednik dohvaća i šalje datoteku na poslužitelj web stranica (mjesta, stranice) prilikom povratka korisnika na njega te se tako korisnicima pruža više online mogućnosti i bolji korisnički doživljaj.

Bitno je naglasiti da LERGISS MK internetska stranica (www.lergiss.com) ne može pristupiti drugim datotekama na računalu korisnika ili dobiti pristup informacijama koje korisnik ranije nije dao. Ne sadrži kolačiće koji omogućuju pokretanje programa ili postavljanje virusa na Vaše računalo.

Podaci koji se prikupljaju uključuju IP adresu korisnika, podatke o pregledniku, jeziku, operativnom sustavu i druge standardne statističke podatke koji se prikupljaju i analiziraju isključivo u anonimnom i masovnom obliku. Internetska stranica www.lergiss.com služi se Google Analytics statistikom. Podatke o tome kako se korisnici koriste internetskom stranicom Lergiss.com povremeno može prikupljati koristeći se i drugim alatima sličnim Google Analytics.

Također, u svrhu planiranja objava sadržaja primjerenih Vašim interesima i budućih marketinških kampanja koristi se alat Google Analytics Demographics and Interest Reporting gdje se mogu upotrebljavati podaci iz Googleova oglašavanja na temelju interesa ili podataka o publici treće strane (npr. dob, spol i interesi) na usluzi Google Analytics.  Detaljne informacije treće strane o ovoj usluzi, kao i o mogućnostima korisnika da reguliraju postavke kolačića koji su za to nužni, dostupne su na Googleovoj internetskoj stranici: https://marketingplatform.google.com/about/analytics/terms/gb/

Dostava se vrši na području Hrvatske i svim zemljama članicama EU: Austrija, Belgija, Bugarska, Češka, Cipar, Danska, Estonija, Finska, Francuska, Grčka, Irska, Italija, Latvija, Litva, Luksemburg, Mađarska, Malta, Nizozemska, Njemačka, Poljska, Portugal, Rumunjska, Slovačka, Slovenija, Španjolska i Švedska).

Brza dostava (u pravilu od 2 do 7 radnih dana), ukoliko su proizvodni dostupni odmah, isključivo vrijedi za Republiku Hrvatsku.

ZEMLJE ČLANICE EU 

Dostava u zemlje izvan Hrvatske može potrajati i do 20 radnih dana, a u pravilu do 5 do 10 radnih dana.

Cijena dostave za zemlje članice EU je besplatna!

Brzina dostave može odstupati od uobičajene u vrijeme blagdana, neradnih dana, tijekom velikih prodajnih akcija i drugih situacija u kojima su moguće poteškoće tijekom isporuke. 

OPĆI UVJETI DOSTAVE I PREUZIMANJA PAKETA

Sve narudžbe šaljemo unutar 2 do 7 radnih dana nakon ispravno izvršene i naplaćene narudžbe ili u vremenskom razdoblju koje je navedeno kao vrijeme izrade na kupljenim proizvodima.

Vrijeme slanja i dostave/isporuke paketa se u slučaju blagdana i državnih praznika prebacuje na prvi sljedeći radni dan.

Želite li dostavu na određeni datum, navedite nam to u napomeni prlikom narudžbe.

Proizvodi će biti zapakirani tako da se uobičajenom manipulacijom u transportu ne mogu oštetiti. Kupac je dužan prilikom preuzimanja pošiljke provjeriti eventualna VANJSKA oštećenja pošiljke tj. paketa i odmah ih reklamirati dostavljaču, odnosno odbiti preuzeti pošiljku na kojoj su vidljiva veća vanjska oštećenja.
U tom slučaju vas molimo da nas kontaktirate kako bismo u što kraćem roku provjerili stanje pošiljke i dogovorili daljnji postupak za vezanu narudžbu tj. pošiljku.

UVJETI POVRATA, REKLAMACIJA I ZAMJENA

JEDNOSTAVNI POVRATI

Ukoliko niste zadovoljni s proizvodom koji ste naručili, možete ga vratiti uz povrat punog plaćenog iznosa, uključujući i iznos dostave ukoliko su ispunjeni uvjeti za to i ukoliko je dostava naplaćena.

Svi proizvodi koje se vraćaju moraju biti nekorišteni i u originalnom pakiranju.

Trošak dostave do našeg skladišta za proizvode koje vraćate snosite samostalno (poštom ili dostavnom službom), osim u slučaju povrata ili zamjene neispravnih proizvoda kada sve troškove snosi obrt LERGISS MK.

NAPOMENE

• Povrati i zamjene moraju biti unaprijed dogovoreni.
• Ukoliko želite povrat sredstava, uz robu koja udovoljava povratu, obavezno mora biti priložena kopija računa te broj računa (IBAN) na koji će se izvršiti povrat sredstava, osim u slučaju ako se povrat vrši direktno na bankovnu karticu kupca.
• Povrat sredstava će biti izvršen sukladno zakonskom roku od 14 dana (ZZP), tj. nakon što zaprimimo proizvod na skladište.
• Prilikom povrata proizvoda, kupac je odgovoran da prikladno zapakira proizvod/e u kartonsku kutiju/kuvertu kako ne bi došlo do oštećenja proizvoda prilikom transporta. Ukoliko do oštećenja dođe jer kupac nije zaštitio proizvod prilikom pakiranja (npr. vraćeni proizvodi zamotani u običan papir ili vrećicu) – povrat ili zamjena neće biti uvaženi.
• Povrat robe morate izvršiti bez odgađanja, a najkasnije u roku 14 dana od dana kada ste izjavili jednostrani raskid ugovora.

OŠTEĆENJA U DOSTAVI, KRIVI PROIZVODI, NEISPRAVNI PROIZVODI

U slučaju oštećenja prilikom dostave, krivo isporučene robe ili je proizvod koji ste dobili neispravan/oštećen, molimo vas da nam se javite e-poštom na: info@lergiss.com u roku od dva radna dana od primitka pošiljke. 

Sve reklamacije riješiti ćemo u najkraćem mogućem roku. U ovim slučajevima obrt LERGISS MK pokriva sve troškove zamjene proizvoda. 

PRAVO NA JEDNOSTRANI RASKID UGOVORA (IZVOD IZ ZZP-A, ČLANAK 72.)

1. Potrošač ima pravo, ne navodeći razloge za to, jednostrano raskinuti ugovor sklopljen izvan poslovnih prostorija ili sklopljen na daljinu u roku od 14 dana.
2. U slučaju sklapanja ugovora o kupoprodaji, rok iz stavka 1. ovoga članka započinje teći od dana kada je potrošaču ili trećoj osobi određenoj od strane potrošača, a koja nije prijevoznik, roba koja čini predmet ugovora predana u posjed.
3. Ako je jednom narudžbom potrošač naručio više komada robe koji trebaju biti isporučeni odvojeno, odnosno ako je riječ o robi koja se dostavlja u više komada ili više pošiljki, rok iz stavka 1. ovoga članka započinje teći od dana kada je potrošaču ili trećoj osobi određenoj od strane potrošača, a koja nije prijevoznik, predan u posjed zadnji komad ili zadnja pošiljka robe.
4. Ako je ugovorena redovita isporuka robe kroz određeni period, rok iz stavka 1. ovoga članka započinje teći od dana kada je potrošaču ili trećoj osobi određenoj od strane potrošača, a koja nije prijevoznik, predan u posjed prvi komad ili prva pošiljka robe.
5. U slučaju sklapanja ugovora o uslugama, ugovora o isporuci vode, plina ili električne energije koji se prodaju u neograničenom obujmu ili neograničenoj količini te isporuci toplinske energije, kao i u slučaju sklapanja ugovora kojemu je predmet digitalni sadržaj koji nije isporučen na tjelesnom mediju, rok iz stavka 1. ovoga članka započinje teći od dana sklapanja ugovora.

OBRAZAC ZA JEDNOSTRANI RASKID UGOVORA

Primjerak obrasca za jednostrani raskid ugovora koji se nalazi na našoj internetskoj stranici možete elektronički ispuniti i poslati. Potvrdu primitka obavijesti o jednostranom raskidu ugovora dostavit ćemo Vam, bez odgađanja, elektroničkom poštom. Obrazac za jednostrani raskid ugovora možete preuzeti ovdje – Obrazac za jednostrani raskid ugovora 

Upute za jednostrani raskid ugovora:

• Ugovor možete jednostrano raskinuti u roku od 14 dana bez navođenja razloga.
• Da biste mogli ostvariti pravo na jednostrani raskid ovoga Ugovora, morate nas obavijestiti o svojoj odluci o jednostranom raskidu ugovora prije isteka roka i to nedvosmislenom izjavom poslanom poštom ili elektroničkom poštom, u kojoj ćete navesti svoje ime i prezime, adresu, broj telefona i adresu elektroničke pošte, a možete koristiti i priloženi primjer obrasca za jednostrani raskid ugovora.
• Rok za jednostrani raskid iznosi 14 dana od dana kada je Vama ili trećoj osobi koju ste Vi odredili, a koja nije prijevoznik, roba koja je predmet ugovora predana u posjed.
• Ako jednostrano raskinete ovaj Ugovor, izvršit ćemo povrat novca koji smo od Vas primili, uključujući i troškove isporuke, bez odgađanja, a najkasnije u roku od 14 dana od dana kada smo zaprimili Vašu odluku o jednostranom raskidu ugovora, osim ukoliko ste odabrali drugu vrstu isporuke a koja nije najjeftinija standardna isporuka koju smo mi ponudili.
• Povrat novca bit će izvršen na isti način na koji ste Vi izvršili uplatu. U slučaju da pristajete na drugi način povrata plaćenog iznosa, ne snosite nikakve troškove u odnosu na povrat.
• Povrat novca možemo izvršiti tek nakon što nam roba bude vraćena ili nakon što nam dostavite dokaz da ste nam robu poslali nazad.
• Smatra se da ste izvršili svoju obvezu na vrijeme ako ste prije isteka naprijed navedenog roka poslali robu na našu adresu.
• Izravne troškove povrata robe morate snositi sami.
• Odgovorni ste za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti robe.

Obveze potrošača u slučaju jednostranog raskida ugovora (izvod iz ZZP-a, članak 77.)

1. Osim ako je trgovac ponudio da robu koju potrošač vraća sam preuzme, potrošač mora izvršiti povrat robe bez odgađanja a najkasnije u roku od 14 dana od kada je, sukladno članku 74. ovoga Zakona, obavijestio trgovca o svojoj odluci da raskine ugovor.
2. Smatra se da je potrošač izvršio svoju obvezu iz stavka 1. ovoga članka na vrijeme ako prije isteka roka iz stavka 1. ovoga članka pošalje robu ili je preda trgovcu, odnosno osobi koju je trgovac ovlastio da primi robu.
3. Potrošač mora snositi samo izravne troškove povrata robe, osim ako je trgovac pristao snositi te troškove ili ako je trgovac propustio obavijestiti potrošača o tome da je dužan snositi te troškove.
4. Ako je, kod ugovora sklopljenog izvan poslovnih prostorija, roba u trenutku sklapanja ugovora bila dostavljena potrošaču u njegov dom, trgovac mora preuzeti robu na svoj trošak ako robu, zbog njezine prirode, nije moguće vratiti na uobičajeni način poštom.
5. Potrošač je odgovoran za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti robe.
6. Iznimno od stavka 5. ovoga članka, ako trgovac nije obavijestio potrošača o njegovu pravu na jednostrani raskid ugovora u skladu s člankom 57. točkom 8. ovoga Zakona, potrošač ne odgovara za umanjenje vrijednosti robe, bez obzira na uzrok umanjenja vrijednosti robe.
7. Ako jednostrano raskine ugovor nakon što je sukladno člancima 64. i 70. ovoga Zakona izričito zahtijevao da pružanje usluge ili ispunjenje ugovora o isporuci vode, plina, električne energije koji se prodaju u neograničenom obujmu ili neograničenoj količini te isporuci toplinske energije započne prije isteka roka za jednostrani raskid ugovora, potrošač je dužan platiti trgovcu dio ugovorene cijene koji je razmjeran onome što je trgovac ispunio potrošaču do trenutka kada ga je potrošač obavijestio o tome da koristi svoje pravo na jednostrani raskid ugovora, s tim da se proporcionalni iznos cijene koji je potrošač dužan platiti izračunava na temelju ukupne ugovorene cijene, a ako je ta cijena neumjerena, na temelju tržišne vrijednosti onoga što je trgovac ispunio potrošaču.
8. Ako jednostrano raskine ugovor o uslugama ili ugovor o isporuci vode, plina ili električne energije koji se prodaju u neograničenom obujmu ili neograničenoj količini te isporuci toplinske energije, potrošač neće biti obvezan platiti dio cijene razmjeran onom što je trgovac ispunio potrošaču za vrijeme trajanja roka za jednostrani raskid ugovora, ako trgovac potrošaču nije dostavio obavijesti predviđene odredbama članka 57. stavka 1. točaka 8. i 10. ovoga Zakona, odnosno ako potrošač nije sukladno člancima 64. ili 70. ovoga Zakona izričito zahtijevao da pružanje usluge započne prije isteka roka za jednostrani raskid ugovora.
9. Ako jednostrano raskine ugovor koji za predmet ima digitalni sadržaj koji nije isporučen na tjelesnom mediju, potrošač neće biti u obvezi platiti dio cijene ili troškova razmjernih onome što je trgovac ispunio potrošaču za vrijeme trajanja roka za jednostrani raskid ugovora, ako nije dao svoj izričit pristanak na to da ispunjenje ugovora započne prije isteka roka od 14 dana iz članka 72. ovoga Zakona, ako nije potvrdio da je upoznat s činjenicom da davanjem takvog pristanka gubi pravo na jednostrani raskid ugovora ili ako je trgovac propustio obavijestiti ga sukladno člancima 63. ili 69. ovoga Zakona.

Isključenje prava na jednostrani raskid ugovora (izvod iz ZZP-a, članak 79.)

Potrošač nema pravo na jednostrani raskid ugovora iz ovoga odsjeka ako je:

• Ugovor o uslugama trgovac u potpunosti ispunio, a ispunjenje je započelo uz izričit prethodni pristanak potrošača te uz njegovu potvrdu da je upoznat s činjenicom da će izgubiti pravo na jednostrani raskid ugovora iz ovoga odsjeka ako usluga bude u potpunosti ispunjena.
• Predmet ugovora roba koja je izrađena po specifikaciji potrošača ili koja je jasno prilagođena potrošaču.
• Predmet ugovora lako pokvarljiva roba ili roba kojoj brzo istječe rok uporabe.
• Predmet ugovora zapečaćena roba koja zbog zdravstvenih ili higijenskih razloga nije pogodna za vraćanje, ako je bila otpečaćena nakon dostave.

Potrošač je dužan snositi troškove vraćanja robe u skladište obrta LERGISS MK u slučaju da iskoristi svoje pravo na jednostrani raskid ugovora iz članka 72. ZZP.

ODGOVORNOST ZA MATERIJALNE NEDOSTATKE

LERGISS MK odgovara za materijalne nedostatke stvari koje prodaje na svojim stranicama sukladno pozitivnim propisima Republike Hrvatske posebice Zakonu o obveznim odnosima.

IZVANSUDSKO RJEŠAVANJA POTROŠAČKIH SPOROVA

U slučaju spora između potrošača i trgovca, može se podnijeti prijava Sudu časti Hrvatske obrtničke komore ili prijedlog za mirenje pri centrima za mirenje.
